On March 11, the clergy and the faithful of the Ukrainian Autocephalous Orthodox Church Canonical held the protest action near the General Prosecutor’s Office of Ukraine and filed the application to the General Prosecutor of Ukraine, Oleksandr Ivanovych Medvedko, on the illegal actions of the workers of Holosiyivskyi District Department of Central Administration of Ministry of Internal Affairs of Ukraine in Kiev S.M. Semykop and Y.P. Riabovol and on the illegal actions of the representative of the Holosiyivskyi Prosecutor’s Office of Kyiv Lysenko S.S. and other workers of law enforcement agencies, who have been breaking grossly the regulations of the Constitution of Ukraine, The Universal Declaration of Human Rights, the provisions of the European Convention on Human Rights in relation to our Church and its Primate, Patriarch Moses
In the application of the community of the UAOC-C to the General Prosecutor of Ukraine was mentioned that we have received only formal non-committal replies to our previous appeals and on the huge number of applications of the deputies of the Verkhovna Rada of Ukraine. Inactivity of the General Prosecutor’s Office of Ukraine concerning the dismissal of the falsified case against Patriarch Moses and the protection of the UAOC-C from total extermination, promotes the subsequent crimes of anathematized Filaret Denysenko, of its church UOC-KP and the Deputy Prosecutor of Uzhgorod Andriy Malynych. By its inactivity, the General Prosecutor’s Office of Ukraine also supports the illegal actions of investigator (Y.P. Riabovol) of the Holosiyivskyi District Department of Central Administration of Ministry of Internal Affairs of Ukraine in Kyiv, who continues breaking the right to protection of Patriarch Moses and at the same time press for the untruthful testimonies of witnesses against Patriarch through intimidation. He says that the people are on anathema put by Patriarch, what is not truth and is invented by the investigator himself.
At the same time, on January 13, 2010, in the Holosiyivskyi District court Judge Novak A.V. did not even try to study the materials of the case which contained only plaints and explanations of a few persons, during the hearing of the complaint of rejection of the institution of the illegal criminal proceeding against Patriarch Moses. Information mentioned in these complaints wasn’t checked by law enforcement agencies, but on its unsubstantiated ground the decision about opening the criminal case was passed.
There is the fact that Judge Novak A.V. had prepared the court decision before the hearing of case. He has been in the decision room for 10-15 minutes but he succeeded in printing three pages A4 of the decision during such short period of time.
All facts mentioned above and other facts written in the application to the General Prosecutor allow asserting that the anathematized Filaret Denysenko, the UOC-KP tries to destroy the UAOC-C by the hands of law enforcement agencies.
In its application the community of the UAOC-C applies to the General Prosecutor, Oleksandr Ivanovych Medvedko, with the request to dismiss the false criminal case against Patriarch Moses for the lack of the body of a crime incriminated to Patriarch; to take measures against the Deputy Prosecutor of Uzhgorod, Malynych A. and to return God’s Temple to the community of UAOC-C in Uzhgorod.
Events which have been developing around the UAOC-C show the level of corruption in the law-enforcement agencies of Ukraine and injustice to the ordinary citizens. It is clear for everyone that the criminal case against Patriarch Moses was ordered and framed-up. But in spite of that fact, the community has to continue struggling for the adoption of legal decision.
We, the community of the UAOC-C, declare that we will pay attention to all violations of the law on the part of investigators or Public Prosecutors. And on every breach of law we will write complaints, held the protest actions in response to every violation f the law. We will defend our legal rights and the legal rights of our Patriarch.
